Terms of use of our services

Atlas Hoster reserves the right to change this policy at any time. It is your responsibility as a client to check the terms of use regularly for any changes that may have occurred. Atlas Hoster strives to offer the best possible service to all our clients, but we will not tolerate any illegal activity or abuse on our servers. We respect freedom of speech and expression, unless it is harmful to others. These brief guidelines are imposed to protect you against such harm.

Policy on payments, fees and refunds: Full payment is required before any service, which includes renewals. All overdue payment notices will be sent by e-mail. Invoices or invoice reminders will be sent by e-mail or by fax. Billing will continue until you cancel your hosting account. If you paid through PayPal with an attached subscription, make sure you cancel your subscription when you cancel your account with us. Failure to cancel the subscription will lead PayPal to charge your account, even after your hosting has been cancelled. Refunds WILL NOT be considered if an additional payment is the client's fault.

Reactivation: Any account deactivated or cancelled for any reason will be charged a fee of 100 DH for the reactivation of the account. If the cancellation is made by Atlas Hoster because of a breach of the restrictions, there will be no refund. Monthly billing: prices are not prorated. Atlas Hoster reserves the right to change its prices at any time.

Account deactivation: You may cancel at any time. A request by telephone does not constitute acceptance of the cancellation. To cancel your account, please contact Customer Service at sales@atlashoster.com or through your client area: https://atlashoster.com/ . Notice of cancellation must be received at least fourteen working days before your cycle date, the cycle date being the day of the month on which you signed up, in order to avoid being charged in full for the next cycle. It is the client's responsibility to obtain confirmation by e-mail from Atlas Hoster that the account has been cancelled. If the client has not yet received an e-mail confirming the cancellation of the account, the account remains active and you will continue to be billed. If the client has a balance due at the time of cancellation, that balance must be paid in full. Cancellation does not release the Client from any financial obligation. If the client cancels a subscription through either PayPal or AlertPay (Payza), it is the same as cancelling by sending a request to billing. Your account will be cut off when the subscription cancellation is received.

Indemnification: You agree to use all Atlas Hoster services and facilities at your own risk. We reserve the right, at any time, to transfer data to and from any server without the client's express consent, for any reason. Atlas Hoster specifically disclaims any warranty of merchantability and of fitness for a particular purpose. In no event shall Atlas Hoster be held liable for any loss or losses of data or other commercial damage, including but not limited to special, incidental, consequential or other damages. The client agrees to defend, indemnify and hold Atlas Hoster harmless from all demands, liabilities, losses, costs and claims, including legal fees, asserted against Atlas Hoster, its agents, its clients, officers and employees. The client agrees to defend, indemnify and hold Atlas Hoster harmless against liabilities arising from:

1. any injury to persons or property caused by products sold or distributed in connection with Atlas Hoster servers;
2. any material supplied by the client that allegedly infringes or encroaches on the property rights of a third party;
3. copyright infringement;
4. any defective products sold to customers from an Atlas Hoster server.

Atlas Hoster shall be the sole arbiter of what violates this policy.

SPAM: Atlas Hoster is committed to a zero-tolerance anti-spamming policy. Under this policy, we prohibit spam, or any unsolicited commercial e-mail. This concerns clients and all other users of Atlas Hoster on the Web (including clients, AND / OR ANY case where the message sent refers to or mentions a site hosted on Atlas Hoster's servers). We react quickly and seriously to violations, and we further reserve the right to terminate the service, without prior notice, of any client who disregards this policy. Sending unsolicited commercial e-mail (or "spam"), cross-posting messages to a large number of Usenet groups, or sending obscene or threatening messages while using or referring to an e-mail address or website hosted by Atlas Hoster is prohibited. An account cancelled because of spam will be charged a "clean-up" fee of 5000 DH. If you have complaints or comments about spam on our network, please send them by e-mail to abuse@atlashoster.com

Content: All services provided by Atlas Hoster may be used for lawful purposes only. This includes, but is not limited to: copyright, trademarks, intellectual property, material we judge to be threatening or obscene, or material protected by trade secret and other statutes without authorisation. The subscriber agrees to indemnify and hold Atlas Hoster harmless against any claim resulting from the use of this service that causes harm to the subscriber or to any other party. Also prohibited are sites that promote any illegal activity or present content that could be harmful to Atlas Hoster's servers or to any other server on the Internet. Links to such material are also prohibited. Examples of unacceptable content or links:

• Pirated software
• Hacker programs or archives
• Warez sites
• Illegal MP3s
• Child pornography
• IProxy scripts
• Wildcard DNS
• Any copyrighted material not belonging to the owner of the site in question

E-mail: Atlas Hoster must not be the source, the intermediary, or the destination address involved in the transmission of any unsolicited e-mail, e-mail bombs, hate e-mail, or any mass e-mail. Your e-mail account may not be referenced as the origin, the intermediary, or the reply address of such a message. We consider mass e-mail to be a message sent to more than 100 e-mail addresses or more than 10 newsgroups.

CGI scripts: Each account comes with its own cgi-bin directory. You are free to use the CGI scripts you wish; however, we reserve the right to disable any CGI script that threatens the normal operation of the server or the service to other Atlas Hoster clients. You will be notified after the offending CGI script has been removed.

Chat: Atlas Hoster allows the installation of "chat" software. However, we will not monitor these chat rooms. We therefore have no control over the course of the discussions. It is up to the Client to moderate its applications.

Traffic policy: We reserve the right to refuse our services to anyone for any reason, for activities that are prohibited by law. We also reserve the right to terminate a client's service for breaking the law. Any attempt to damage our servers, or any other malicious activity, will lead to the immediate deactivation of the account without notice.
