Terms of sale

Last updated: October 30, 2026

1. Purpose

These terms of sale govern the hosting, server rental, managed services and associated services (domain names, e-mail, backups, security) provided by Atlas Hoster ("we") to the client ("you"). Any order implies acceptance of the terms in force on its date.

2. Ordering and set-up

An order is placed on the site, in the client portal or through an accepted quote. We confirm availability, then set the service up after the first payment is received (or as the quote states). Credentials are handed over in the client portal, never by plain e-mail.

3. Prices, taxes and currencies

Prices are stated excluding tax. For a client established in Morocco, the applicable VAT (20 %) is added and prices are in dirhams. For a client established outside Morocco, services are invoiced in euros and exempt from VAT as an export of services, the client remaining liable for the taxes of its country. We may revise the price of a plan for the following periods, with thirty days' notice.

4. Payment

Payment methods are bank transfer, card through YouCan Pay (Morocco) and PayPal (outside Morocco). Invoices are payable on receipt unless a due date is stated. A late payment may lead, after a reminder, to the suspension of the service and then its termination; data is kept during the suspension for the period shown in the portal.

5. Term, renewal and termination

Services are subscribed for the chosen period (monthly, quarterly, yearly…) and renewed tacitly for an identical period. The client may terminate at any time for the end of the current period, from the portal or in writing; no started period is refunded unless stated otherwise. We may terminate a service for a serious breach of these terms (unlawful use, non-payment) after a formal notice left without effect for seven days, or without notice when the security of the infrastructure or of third parties is at stake.

6. The client's obligations

The client is responsible for the hosted content, the lawfulness of its activity, the security of its applications and credentials, and the backup of its data beyond the backup services subscribed. The client undertakes not to use the services to send unsolicited messages, host unlawful content or harm third parties.

7. Our obligations

We provide the services diligently, in accordance with the service levels described in the "Service level agreement (SLA)" document, and we inform the client of incidents and maintenances through the portal and the channels it chose. We do not read the client's content except for technical necessity or legal obligation.

8. Liability

Our liability is limited to direct damages and capped at the amounts paid by the client for the service concerned over the last twelve months. We are not liable for indirect losses (loss of revenue, of data not backed up, of reputation). The credits provided by the SLA are the sole compensation for unavailability.

9. Personal data

The data processed is described in the privacy policy. The client remains the controller of the personal data it hosts; we act as a processor, in accordance, where applicable, with the GDPR, and we undertake to process it only on the client's instructions and to protect it.

10. Governing law

These terms are governed by Moroccan law. Any dispute is brought, failing an amicable settlement, before the competent courts of Casablanca.
